Govt clarifies that the new gratuity ceiling applies only to central civil servants under CCS Pension Rules—not PSU, RBI, bank, or state employees
₹25 Lakh Gratuity Limit: What’s the Update?
The Central Government has officially clarified the scope of its enhanced gratuity ceiling — now capped at ₹25 lakh, up from the earlier ₹20 lakh.
Who is eligible?
Only regular Central Government civil servants governed by either:
- Central Civil Services (Pension) Rules, 2021, or
- CCS (Payment of Gratuity under National Pension System) Rules, 2021
This clarification rules out a wide group of public employees previously uncertain about their eligibility.
Who is Not Covered Under the New Rules?
The following categories of employees are not eligible for the revised ₹25 lakh gratuity limit:
- Employees of Public Sector Undertakings (PSUs)
- Bank staff (including nationalised banks)
- RBI employees
- Staff of port trusts, autonomous bodies, universities, and state governments
- Employees under government-affiliated societies
The Department of Pension and Pensioners’ Welfare (DoPPW) emphasized that these employees are governed by separate service rules, not by the CCS Pension Rules.
Why the Clarification Was Issued
The government said it had been receiving numerous queries, RTIs, and representations asking if the higher gratuity cap applies to other institutions.
To end the confusion, DoPPW issued a statement reiterating that:
“These rules are not applicable to societies, banks, ports trusts, RBI, PSU, autonomous bodies, universities, state governments etc.”
Queries regarding the gratuity eligibility of such organisations must be directed to the respective administrative ministry or department.
Why Was the Gratuity Limit Increased?
The hike was triggered by the Dearness Allowance (DA) for central employees touching 50% of basic pay in early 2024.
Under 7th Pay Commission norms, when DA crosses this threshold:
- All allowances get a 25% upward revision
- So does the gratuity ceiling, as part of retirement benefits
Effective from: January 1, 2024
Old limit: ₹20 lakh
New limit: ₹25 lakh
The decision was officially notified by the government on May 30, 2024.
Who Can Get Up to ₹25 Lakh in Gratuity?
To recap, the increased gratuity limit applies only to:
✅ Regular Central Government Civil Servants
✅ Covered under:
- CCS (Pension) Rules, 2021, or
- CCS (Payment of Gratuity under NPS) Rules, 2021
What Should Employees in PSUs, Banks, and States Do?
If you’re employed by a non-central entity (like a PSU or state government), you need to:
- Check the gratuity rules governing your organisation
- Contact your administrative ministry or HR department for updates
- Note: Many such institutions follow Payment of Gratuity Act, 1972, which currently allows ₹20 lakh as the gratuity ceiling unless revised by the respective employer or governing body
Final Take: One Rule Doesn’t Fit All
While the revised ₹25 lakh gratuity cap is great news for central government employees, it doesn’t apply universally.
Employees of banks, PSUs, RBI, and states must not assume automatic eligibility. Instead, they should check their specific service rules or contact their HR or pension division for clarity.
The DoPPW’s clarification ends speculation but also puts the onus on other departments to update their own gratuity frameworks if they choose to match the central government’s move.
Only central government civil servants covered under CCS (Pension) Rules, 2021 or CCS (Gratuity under NPS) Rules, 2021 are eligible for the enhanced ₹25 lakh gratuity limit. PSU, bank, RBI, university, and state government employees remain excluded.
